Terms of service

Draft
These terms are not in effect yet. Still missing: the provider’s name, the address, the contact e-mail, the date they take effect.

1. General

These terms set out how you can use FluentSession, an app for learning to speak English in voice conversations with an AI tutor, available in a web browser.

The service is provided by [to fill in: provider name], [to fill in: address], e-mail: [to fill in: e-mail] ("we").

These terms are the rules referred to in Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means. You accept them when you create an account. They are available free of charge at this address, and you can print or save them.

Terms used here:

  • Account: your FluentSession account, created with an e-mail address and a password.
  • Tutor: the program (a language model) you talk with. The tutor is not a person.
  • Room: the settings of a conversation you choose: the situation, goal, level, correction style, and the tutor’s voice and accent.
  • Conversation: one speaking session with the tutor, from its start to its end.
  • Minutes: conversation time you can use.
  • Plan: a paid subscription that gives a set number of minutes every month.
  • Top-up: minutes bought once.
  • Mistakes vault: corrections saved from your conversations, which you review like flashcards.

2. What we offer

  • Voice conversations with the tutor in ready-made rooms or rooms you set up.
  • Corrections and translations during the conversation.
  • An assessment after each conversation: scores, an estimated level, the main mistakes and better ways to say things.
  • A mistakes vault with reviews, and a history of your progress.

The account, history, assessments and mistakes vault are free. Conversation time with the tutor (minutes) is paid, except for the free minutes you start with.

The tutor and the assessment run on artificial intelligence models and can be wrong: in corrections, translations and the assessment. The level is an estimate to help you follow your progress. It is not a certificate or an exam result.

Speech recognition can mishear words, especially in noise. You can mark a line the system misheard; its correction then disappears and does not count in the assessment.

3. Technical requirements

  • A device with internet access and a microphone; we recommend headphones.
  • An up-to-date browser (Chrome, Edge, Firefox or Safari) with JavaScript and cookies enabled.
  • Browser permission to use the microphone during a conversation.
  • A working e-mail address.

Using the internet carries the usual risks, such as malware or a stolen password. Use a strong password, do not share it, and sign out on devices that are not yours.

4. Your account

You can create an account only if you are at least 18. The service is not intended for anyone under 18.

You create the account with an e-mail address and a password, then confirm the address with the link we send. An account whose address is not confirmed within 30 days and in which no conversation took place is deleted.

One person may have one account and does not share it. Creating further accounts to get free minutes again is not allowed.

You can delete your account at any time in the account settings. Deletion is immediate and cannot be undone: rooms, conversations, assessments, the mistakes vault and unused minutes are gone. The page How we keep your data has the details. Deleting your account does not take away your right to complain or to withdraw from the contract.

5. Minutes and how they are counted

A new account gets 10 free minutes once.

A conversation is counted to the second, from its start to its end. The whole conversation counts, including when the tutor speaks and silences. The server measures the time.

The exception is a break you ask for during a conversation: its time is not counted, and the microphone is off meanwhile. A conversation can have at most 5 breaks, each at most 15 minutes long. When a break lasts longer, we close the conversation and count it up to the start of the break.

If a conversation is abandoned (for example, you close the tab) and nothing happens in it for 15 minutes, we close it and count it up to your last line.

When your minutes run out, the conversation ends. You can then buy a plan or a top-up.

Minutes from a plan renew every month and do not carry over to the next month. Top-up minutes are valid for 12 months from purchase and are used only after the plan’s minutes.

6. Plans, top-ups and payments

Current prices (gross, VAT included):

PlanMinutesPrice
Start120 min a month29 zł
Standard300 min a month59 zł
Intensive600 min a month109 zł
Standard, 3 months300 min a month, for 3 months159 zł
Intensive, 3 months600 min a month, for 3 months289 zł
Top-up60 min once, valid 12 months19 zł
Top-up180 min once, valid 12 months45 zł

Payments are handled by Lemon Squeezy as the merchant of record: it takes the payment, issues the receipt and handles the tax. Its own terms also apply to the payment itself. Until payments launch, only the free minutes are available.

A plan renews automatically for the next period (one month or 3 months) until you cancel it. You can cancel at any time; the cancellation takes effect at the end of the paid period, and you can use that period’s minutes until it ends.

A price change does not affect a period that has already been paid for. We will tell you by e-mail at least 14 days before a renewal if the price of your plan changes.

7. Limits that protect the service

Every conversation costs us fees for speech recognition, the tutor’s replies and the tutor’s voice. So that nobody can abuse the service at others’ expense, conversations have technical limits. An ordinary conversation never reaches them:

  • at most 20 tutor replies a minute, and only one at a time;
  • at most 15 starts of speech recognition a minute;
  • a cap on the service cost of one conversation, which grows with its length;
  • at most 300 plays of vault cards a day.

A request over a limit is refused. When a conversation goes over the cost cap, it ends and is counted up to that moment, so you do not lose minutes.

8. Rules of use

You may not:

  • enter unlawful or offensive content, or content that infringes other people’s rights;
  • enter other people’s personal data in rooms or conversations without their consent;
  • get around limits or security, use bots or scripts instead of a browser, download content in bulk or disrupt the service;
  • share your account or create several accounts to get free minutes.

If an account breaks these terms, we may block it. A blocked account can see its history but cannot start conversations or use AI drafts in rooms. We will tell you about the block and why. You can appeal at [to fill in: e-mail].

For a serious or repeated breach we may end the contract with 14 days’ notice, which we send by e-mail.

9. Content

What you create (room settings, what you say) belongs to you. You allow us to process it as far as the service needs, including through the providers that recognise speech and generate the tutor’s replies.

The app, its design, texts and recordings are protected by copyright. You may use them only within the service, for your own learning.

10. Complaints

You can send a complaint by e-mail to [to fill in: e-mail]. Describe the problem, give your account’s e-mail address and, if it concerns a conversation, its date. We will answer within 14 days.

If a failure on our side makes you lose minutes or keeps you from using the service, write to us and we will treat it as a complaint. Payment complaints can also go directly to Lemon Squeezy.

11. Withdrawal

As a consumer you can withdraw from the purchase of a plan or a top-up within 14 days of buying it, without giving a reason. The “Withdraw” button in the account settings, shown during those 14 days, a message to [to fill in: e-mail] or a request in Lemon Squeezy is enough. A sole trader has the same right when the contract is not of a professional nature for them.

If, at your own request, you start using the minutes you bought before the 14 days are over, on withdrawal you pay for the part of the service provided until then, in proportion to the minutes used, and the unused minutes of that purchase leave your account. The rest is refunded within 14 days, by the same payment method.

12. Availability and liability

We work to keep the app running without interruption, but maintenance breaks and failures can happen, including at our service providers. We try to announce planned breaks in advance.

We do not guarantee particular learning results: they depend on how regularly you practise and on your work. The limits of liability in these terms do not apply to consumers where the law does not allow them.

13. Personal data

The controller of your personal data is the provider named in section 1. We process it to provide the service (Article 6(1)(b) GDPR) and in our legitimate interest: for security, protection against abuse and statistics on how the service works (Article 6(1)(f) GDPR).

What we store and how long we keep it is described on the page How we keep your data. It also lists every provider that processes data for us: what for, what data, where and on what basis. Most of them operate outside the European Economic Area, including in the USA. Data reaches them under the safeguards the GDPR provides for, such as standard contractual clauses or a European Commission adequacy decision.

You have the right to access your data, to have it corrected or erased, to restrict its processing, to data portability and to object. Write to [to fill in: e-mail] about it. You can also complain to the Polish data protection authority (Prezes Urzędu Ochrony Danych Osobowych).

14. Changes to these terms

We may change these terms for a good reason, such as a change in the law, in prices or in the app’s features. We will tell you about changes by e-mail at least 14 days before they take effect. If you do not accept them, you can delete your account or cancel your plan before that day.

15. Final provisions

Polish law applies. This does not take away the protection a consumer has under the mandatory laws of the country where they live.

Disputes are settled by the court that has jurisdiction under the law. A consumer can also use out-of-court options, such as a municipal or district consumer ombudsman or mediation at the regional Trade Inspection office.

These terms apply from [to fill in: effective date].
